These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Inclivity LLC, a Wyoming limited liability company doing business as The Tag Prospector ("Company," "we," "us," or "our"). By accessing or using this website (thetagprospector.com) or purchasing any digital product from us, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease use of this website and refrain from making any purchase.
By completing a purchase on this website, you represent and warrant that you have read and understood these Terms, have the legal capacity to enter into a binding agreement, and agree to be legally bound by these Terms. Your electronic acknowledgment at the time of purchase constitutes your digital signature and acceptance of this agreement.
The Tag Prospector provides informational digital products ("Reports") to assist big game hunters with draw planning, multi-state strategy, and hunt-specific cost analysis for the states of Utah, Colorado, Wyoming, Arizona, and Nevada. All Reports are digital documents delivered electronically to the email address provided at the time of purchase, are compiled from publicly available historical draw data published by state wildlife agencies and other public sources, and are intended solely for informational and personal planning purposes. The Company offers the following Reports:
The Tag Report — A personalized draw odds report for a single state, species, residency status, and preference point value selected by the User at the time of purchase. The Tag Report includes historical draw trends, harvest success rates, and point creep analysis for hunts within the User's selected parameters.
The Prospector's Playbook — A multi-state, multi-year strategy document for hunters applying across multiple states. The Playbook integrates the User's hunter profile and entered point balances across selected states and species to produce a personalized application roadmap. Pricing varies by entry count, as disclosed at the time of purchase.
The Scout Report — A hunt-specific report for a single hunt code selected by the User from the available qualifying hunt list. The Scout Report provides point creep analysis against the User's current point balance to estimate when the hunt may become drawable, together with a projected total cost of ownership ("TCO") combining historical, current, and projected application and tag fees. Not all hunt codes are available; the Scout Report is limited to hunts meeting the Company's qualifying criteria as determined at the time of purchase. For Wyoming, the Scout Report covers Non-Resident hunters only; Wyoming Residents are directed to The Tag Report. The points input is capped at 26, reflecting the Company's fee and draw history window beginning in the year 2000. Hunters who have accumulated more than 26 preference or bonus points are advised to enter 26; projections generated under this cap remain valid but may be slightly conservative relative to the hunter's actual point total.
Reports are specific to the parameters selected at the time of purchase. It is the sole responsibility of the User to provide accurate inputs (point balances, residency, hunter profile, hunt codes, etc.) and to select the correct options prior to completing payment. The Company does not accept responsibility for Reports purchased with incorrect selections or inaccurate inputs.
Upon successful payment, your Report will be delivered electronically to the email address provided at checkout. Delivery is typically immediate but may be subject to minor delays due to email provider processing times. The Company is not responsible for Reports that are undelivered, delayed, or filtered into spam or junk folders due to the settings or policies of your email provider or mail client.
It is your responsibility to provide an accurate, functioning email address and to check your spam or junk folder if your Report does not appear in your inbox within a reasonable time. If you have not received your Report within 24 hours of a confirmed payment, please contact us at tagprospector@gmail.com and we will resend it to you.
ALL SALES ARE FINAL AND NON-REFUNDABLE. Our Reports are digital documents delivered electronically to the email address provided at checkout. The Tag Report and The Scout Report are made available immediately upon payment. The Prospector's Playbook is delivered within approximately one (1) business day following payment, after internal quality review. We do not offer refunds, exchanges, store credits, or chargebacks under any circumstances once a Report has been delivered to the email address provided.
By completing your purchase, you expressly acknowledge and agree to this no-refund policy and waive any right to dispute or reverse the charge on the basis that the digital product was delivered as described. If you believe your Report was not delivered, please contact us before initiating any payment dispute.
THE COMPANY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, TIMELINESS, OR SUITABILITY OF ANY INFORMATION CONTAINED IN OUR REPORTS. Draw odds data is historical in nature and is derived from publicly available state records. Past draw odds are not predictive of future draw results. State wildlife agencies may alter draw structures, point systems, or tag allocations at any time without notice. Hunt unit codes, hunt designations, and application identifiers used in Reports are derived from historical draw data and may not correspond to current-year identifiers as published by state wildlife agencies, which are subject to renumbering or restructuring at any time.
Purchasing a Report does not guarantee, represent, or imply that you will draw a hunting tag for any unit, species, or season. The Company expressly disclaims any liability for decisions made in reliance on information contained in a Report. Reports that include forward-looking projections of future application fees, tag costs, or total cost of ownership ("TCO") are estimates derived from current and historical fee schedules; state wildlife agencies may change fees, tag costs, and point costs at any time, and such changes will not be reflected in previously delivered Reports.
Scout Report draw-timeline projections assume the User will apply for the selected hunt continuously and without interruption in each draw year from the current year forward. Projections are based on the historical floor trend derived from data available at the time of purchase and do not account for future changes to hunt structure, tag allocations, draw system rules, or applicant pool composition. The accuracy of Scout Report projections decreases over longer time horizons. Where the User's point total exceeds the 26-point input cap, the resulting projection may underestimate the User's actual proximity to the draw floor. Users with high point totals are encouraged to verify their draw eligibility directly with the applicable state wildlife agency before making application or travel decisions.
Reported draw odds are calculated from historical applicant and tag allocation data as published by state wildlife agencies. In units where the number of tags allocated is very small — including units where only one (1) tag was allocated in a given year — historical draw results may not reflect statistically reliable probability estimates. A single applicant drawing a single available tag produces a 100% historical success rate that carries limited predictive value. Similarly, a single unsuccessful applicant pool against a single tag produces a 0% result that may overstate difficulty. Users should exercise caution when interpreting draw odds for low-allocation units and consider consulting multiple years of data and the relevant state agency's published draw summaries before making application decisions.
